The website may contain material from RailCorp, CountryLink or CityRail as well as other associated companies, entities and business partners including those from other States and Territories of Australia. For the purposes of these Terms of Use, the above parties may be collectively referred to as “CountryLink”.

2. The following items are the Terms of Use for the CountryLink website, and the web services provided through the use of this site.

3. Upon submitting all necessary particulars to CountryLink website for the setting up of their accounts; Users are authorised to access the full extent of CountryLink general content and all CountryLink online services across the CountryLink network, including the electronic transaction and ticket purchase facility.

4. Users must not use or access the CountryLink website for any purpose other than for accessing, perusing timetabling information, reviewing bookings, and utilising the online payment facility for available CountryLink services from the website. Users must not use, modify or otherwise interfere with the CountryLink Network in any manner that is unlawful, prohibited by these Terms of Use, or is otherwise deemed inappropriate by CountryLink staff. Any breach of this term will result in Users being immediately suspended from further usage, User Profile denial and all rights terminated from continuing new User Profile access, and cancellation of any rail tickets that may have been issued.

5. Your access to, and use of the information, materials and services provided on this website are conditional upon your acceptance and compliance with the terms and conditions, as well as any relevant notices and disclaimers that are contained on this website.

To the fullest extent permitted by law, CountryLink’s aggregate liability for breach of any implied warranty or condition which cannot be excluded, is limited at the option of CountryLink in the case of services supplied by CountryLink to the following: (a) the supply of services again, or (b) the payment of the cost of having the services supplied again.

These Terms and Conditions of Use are effective until terminated by CountryLink, and CountryLink may terminate this Agreement and your access to the CountryLink network at any time without notice. In the event of termination you are no longer authorised to access the CountryLink website and network.

Procuring Products and Services using this Website

13. All bookings, purchases and transactions completed through the use of this website are considered to be binding agreements between you and CountryLink. CountryLink reserves the right to charge an applicable service fee for the re-issue and replacement of tickets (or otherwise in circumstances where the CountryLink Network User has not acted in accordance with these Terms and Conditions of Use or the Terms and Conditions of Travel.)

14. CountryLink reserves the right to modify, change and withdraw train services and schedule information at any time.

15. Where passwords, payment details and receipt information, ticketing advice or other sensitive information and documentation (whether in electronic or other format) are issued by Countrylink to the recipient, then that person (and/or the Customer of the CountryLink rail services) undertakes to take all necessary measures to protect such information on behalf of CountryLink and to use such information only for their intended purpose.

Damages

16. The limitations of liability described in these Terms and Conditions applies to direct, indirect, special, punitive, consequential or other damages you or third parties may suffer. This disclaimer includes damages for loss of profit, business interruption, the loss of data or information, or damage to your personal equipment.

17. The limitations of liability described in these Terms and Conditions applies even if CountryLink has been informed in advance of possible interruption or damage to the service.

CountryLink does not have any control over other websites, and CountryLink does not endorse, and is not responsible, for their quality or content. 27. CountryLink advises that you should ensure that your computer systems are updated with virus scanning technology. Although CountryLink regularly updates its own virus scanning technology, it does not accept liability for the potential transmission of viruses to your computer through your use of this website.

Transactions and Record Keeping

29. All bookings, purchases and transactions completed through the use of this website are considered to be binding agreements between you and CountryLink.

30. All enquiries and correspondence made between you and CountryLink through the use of this website are stored in secure systems.. Correspondence pertaining to enquiries, bookings, purchases and transactions can, at your request, be reproduced during the period in which the correspondence material is retained.

31. All formal records of bookings, purchases and transactions by you through the use of this website are stored by CountryLink in accordance with current regulatory and bank validation requirements.

32. For all bookings and transactions where you make an online payment, a Tax Invoice and itinerary will be produced and sent in electronic form to the email address you have specified. CountryLink bears no responsibility for financial records that are sent to an email address that is incorrectly specified by you.

33. At your request, a Tax Invoice and itinerary can be reproduced and sent to an alternative email address, but only after you are able to correctly identify and validate your identity and your right to possess the travel information including any related personal information that may be required concerning the validation of any submitted banking and payment details.

34. All formal records of bookings, purchases and transactions may be reproduced or discovered for the purposes of internal audit by CountryLink its business partners; or for external legal, financial or government audit.

35. All formal records of enquiries, correspondence, bookings, purchases and transactions may be reproduced for the purposes of dispute resolution and handling between CountryLink and a customer, or between CountryLink and its business partners.

36. All formal records of bookings, purchases and transactions made between you and CountryLink contain a signature that is verified through the secure use of a personalised customer account, login and password. A formal transaction record is only deemed to be valid if the password has been used to correctly authenticate and verify you as the customer.

CountryLink Business Partners

37. Countrylink undertakes not to disclose personal information to commercial third partners without your consent. However, CountryLink may share personal information to other organisations within the Countrylink and RailCorp organisation and the business partners of CountryLink include the following:

  • CityRail 
  • Queensland Rail
  • Victorian Railways
  • Great Southern Railways

This Agreement is governed by the non-exclusive jurisdiction of the Courts of New South Wales, Australia. If any part of this Agreement is considered to be invalid then this Agreement is to be read down to the extent that the remaining clauses continue to be enforceable and of full effect.
